2. Service Description

WestPeak Adventures provides outdoor adventure experiences across Canada, including but not limited to:

• Mountain hiking and trekking expeditions
• Winter sports adventures and training
• Wilderness water sports and canoeing
• Wildlife observation tours
• Environmental conservation projects
• Adventure equipment rental and sales

All services are provided by certified and experienced guides following established safety protocols and environmental conservation practices.

3. Booking and Payment Terms

Booking Requirements

To book any adventure experience, participants must:

• Be at least 18 years of age or have guardian consent
• Provide accurate personal and contact information
• Complete health and fitness assessments as required
• Agree to all safety waivers and liability releases

Payment and Cancellation

Full payment is required at the time of booking unless otherwise specified. Cancellation policies vary by adventure type:

• Day adventures: 48-hour cancellation notice for full refund
• Multi-day expeditions: 14-day cancellation notice for 90% refund
• Winter sports programs: 7-day cancellation notice for 80% refund
• Weather-related cancellations: Full refund or rescheduling options

4. Safety and Liability

Participant Responsibilities

Participants are required to:

• Disclose all medical conditions and fitness limitations
• Follow all safety instructions and guidelines
• Use provided safety equipment properly at all times
• Maintain appropriate physical fitness for chosen activities
• Respect environmental conservation principles

Assumption of Risk

Adventure tourism activities carry inherent risks. By participating, you acknowledge and accept these risks, including but not limited to weather conditions, terrain hazards, equipment failure, and wildlife encounters. WestPeak Adventures maintains comprehensive safety protocols but cannot eliminate all risks associated with outdoor activities.

Liability Limitation

WestPeak Adventures' liability is limited to the amount paid for services. We maintain appropriate insurance coverage but participants are strongly advised to secure personal travel and adventure insurance coverage.

5. Code of Conduct

All participants must adhere to our environmental and social responsibility standards:

• Practice Leave No Trace principles in all wilderness areas
• Respect wildlife and natural habitats
• Follow local regulations and indigenous community guidelines
• Maintain respectful behavior toward guides and other participants
• Avoid activities that could damage ecosystems or disturb wildlife

Violation of these standards may result in immediate removal from activities without refund.

6. Intellectual Property

All content on our website, including text, graphics, logos, photographs, and software, is the property of WestPeak Adventures and protected by copyright laws. You may not reproduce, distribute, or create derivative works without express written permission.

Participants grant WestPeak Adventures permission to use photographs and videos taken during adventures for promotional purposes unless explicitly opted out in writing.

7. Privacy and Data Protection

We are committed to protecting your privacy and personal information. Our collection and use of personal data is governed by our Privacy Policy, which forms an integral part of these Terms of Service.

Personal information collected during booking includes emergency contacts, medical information, and preferences necessary for safe adventure delivery.

8. Force Majeure

WestPeak Adventures is not liable for delays, cancellations, or modifications to services due to circumstances beyond our control, including:

• Severe weather conditions or natural disasters
• Government restrictions or park closures
• Transportation strikes or mechanical failures
• Public health emergencies or travel restrictions
• Wildlife management decisions affecting access

In such cases, we will offer alternative dates or provide appropriate refunds according to our cancellation policy.

9. Modifications to Terms

WestPeak Adventures reserves the right to modify these Terms of Service at any time. Changes will be posted on our website with updated effective dates. Continued use of our services after modifications constitutes acceptance of updated terms.

Significant changes affecting existing bookings will be communicated directly to affected participants with appropriate notice periods.

10. Governing Law and Disputes

These Terms of Service are governed by the laws of Canada and the province where services are delivered. Any disputes will be resolved through:

1. Direct negotiation and communication
2. Mediation through recognized adventure tourism associations
3. Binding arbitration in appropriate Canadian jurisdiction

Participants waive the right to class action lawsuits and agree to individual dispute resolution procedures.
